These Terms & Conditions govern the use of the website, online rental listings, leasing inquiry forms, showing request tools, application links, communication systems, resident resources, owner resources, and related online services provided by Coldwell Banker Residential Property Management (“CBRPM,” “Company,” “we,” “us,” or “our”).

By accessing our website, submitting information, requesting a showing, applying for a rental property, using our online tools, or communicating with us electronically, you agree to these Terms & Conditions.

If you do not agree with these Terms & Conditions, you should not use our website, online services, or electronic communication tools.

1. Company Role and Representation

Coldwell Banker Residential Property Management is a property management company that represents property owners. CBRPM does not provide tenant representation.

Information provided through our website, rental listings, leasing communications, showing coordination, application process, resident portals, owner portals, emails, text messages, or other communications is provided for informational and operational purposes only.

Nothing on our website or in our communications creates an agency relationship, fiduciary relationship, attorney-client relationship, or tenant representation relationship between CBRPM and any prospective resident, applicant, tenant, occupant, vendor, or third party.

2. Use of Website and Online Services

You may use our website and online services only for lawful purposes and in accordance with these Terms & Conditions.

You agree not to:

  • Submit false, misleading, incomplete, or inaccurate information;
  • Attempt to access systems, portals, accounts, or information that you are not authorized to access;
  • Interfere with the operation, security, or functionality of our website or online services;
  • Use our website, listings, forms, or communication tools for fraudulent, abusive, unlawful, or improper purposes;
  • Copy, scrape, reproduce, or misuse rental listing information, photos, property descriptions, or other website content without authorization.

We reserve the right to restrict, suspend, or deny access to our website, online services, rental inquiry tools, showing systems, application links, or communication channels if we believe misuse has occurred.

3. Rental Listings and Property Information

Rental listings, availability, pricing, security deposits, fees, lease terms, amenities, utilities, pet policies, resident benefit programs, move-in dates, property condition, and other property information are subject to change without notice.

CBRPM makes reasonable efforts to keep listing information accurate and current. However, we do not guarantee that all listing information is complete, current, error-free, or available at the time it is viewed.

A property is not secured, reserved, or guaranteed until all required approvals are completed, all required funds are paid, and a lease agreement is fully executed by all required parties.

Photos, descriptions, square footage, school information, amenities, and other listing details may be approximate or provided by third-party sources. Prospective residents and applicants are responsible for verifying information that is important to their rental decision.

4. Showings and Leasing Inquiries

Submitting a leasing inquiry, requesting a showing, scheduling a showing, attending a showing, or communicating with CBRPM or its service providers does not guarantee property availability, application approval, lease execution, or move-in.

Showings may be subject to identity verification, availability, property access restrictions, tenant-occupied showing limitations, owner instructions, leasing policies, staff availability, vendor availability, technology limitations, and other operational requirements.

CBRPM reserves the right to cancel, reschedule, limit, or deny showings when necessary for safety, security, availability, access, compliance, owner instructions, or operational reasons.

5. Applications and Screening

Submitting an application does not guarantee approval, lease execution, property availability, or move-in.

All applications are subject to applicable screening criteria, verification, owner approval where applicable, fair housing compliance, and other lawful requirements. Application fees, administrative fees, or other charges may be non-refundable unless otherwise required by law or stated in writing.

CBRPM may use third-party application, screening, verification, fraud-prevention, identity-verification, income-verification, or background-check providers. Applicants may be required to agree to separate terms, disclosures, authorizations, or privacy policies from those third-party providers.

Applicants are responsible for submitting complete, accurate, and truthful information. False, misleading, incomplete, or unverifiable information may result in denial, cancellation, lease termination, or other action allowed by law or contract.

6. Equal Housing Opportunity and Fair Housing Compliance

CBRPM is committed to complying with applicable federal, state, and local fair housing laws.

CBRPM does not unlawfully discriminate on the basis of race, color, religion, sex, national origin, disability, familial status, or any other protected class under applicable law.

Property-specific requirements, application criteria, occupancy standards, pet policies, animal policies, owner instructions, and leasing terms will be applied in accordance with applicable law.

Requests related to assistance animals, service animals, reasonable accommodations, or reasonable modifications will be reviewed in accordance with applicable fair housing laws and company procedures.

7. Pets, Assistance Animals, and Property-Specific Policies

Pet policies may vary by property and owner. Pets are subject to approval unless otherwise required by law.

Pet fees, pet rent, pet deposits, animal limits, breed restrictions, weight restrictions, insurance requirements, and other animal-related rules may vary by property. Some properties may not allow pets.

Assistance animals and service animals are not considered pets and will be reviewed in accordance with applicable fair housing laws and company procedures.

Prospective residents and applicants are encouraged to disclose animals early in the leasing process so that property-specific requirements can be reviewed.

8. Resident, Tenant, and Owner Portals

CBRPM may provide access to online portals for applications, rent payments, maintenance requests, lease documents, owner statements, inspections, communication, or other property-management purposes.

Portal access may be provided through third-party platforms. Use of those platforms may be subject to separate terms, conditions, privacy policies, fees, and user agreements.

Users are responsible for maintaining the confidentiality of their login credentials and for any activity occurring through their accounts.

CBRPM is not responsible for unauthorized access caused by a user’s failure to protect login information, email access, device access, or account credentials.

9. Third-Party Platforms and Service Providers

CBRPM may use third-party platforms and service providers to support leasing, showings, applications, tenant screening, communications, payments, inspections, maintenance, utilities, resident services, owner services, reputation management, and other property-management functions.

These platforms may include, but are not limited to, leasing software, showing coordination tools, application processors, tenant screening providers, resident portals, owner portals, maintenance systems, inspection platforms, communication providers, utility coordination services, and payment processors.

Third-party platforms may have their own terms, conditions, privacy policies, fees, disclosures, and user requirements. CBRPM is not responsible for the content, security, availability, errors, omissions, outages, or practices of third-party platforms.

Use of a third-party platform does not change CBRPM’s role as property manager for the owner and does not create tenant representation.

10. Electronic Communications

By submitting information to CBRPM, requesting a showing, applying for a rental property, creating an account, using a portal, or otherwise communicating with us electronically, you consent to receive communications from CBRPM and its authorized service providers by email, phone, text message, portal message, and other electronic methods, subject to applicable law.

Electronic communications may include leasing information, showing updates, application updates, property availability, move-in information, resident account information, maintenance communications, renewal information, owner communications, notices, service updates, and other property-management-related communications.

You are responsible for ensuring that your contact information is accurate and current.

11. SMS/Text Messaging Terms

By providing your mobile phone number to CBRPM, submitting a leasing inquiry, requesting a showing, applying for a rental property, using our online services, or otherwise opting in to receive text messages, you consent to receive SMS/text messages from Coldwell Banker Residential Property Management and its authorized service providers.

Text messages may include, but are not limited to:

  • Leasing inquiries;
  • Showing scheduling and reminders;
  • Application updates;
  • Property availability updates;
  • Move-in instructions;
  • Resident account communications;
  • Maintenance-related communications;
  • Renewal communications;
  • Owner or resident service communications;
  • Other property-management-related communications.

Message frequency may vary depending on your relationship with CBRPM and your use of our services.

Message and data rates may apply.

You may opt out of SMS/text messages at any time by replying STOP. After opting out, you may receive a confirmation message, and you will no longer receive SMS/text messages from that messaging campaign unless you opt in again.

Consent to receive SMS/text messages is not a condition of renting a property, purchasing services, or entering into an agreement with CBRPM, except where text messaging is necessary for a specific service you request and permitted by law.

Mobile phone numbers, SMS opt-in data, and text messaging consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Information may be shared with service providers only as necessary to deliver messages, operate our communication systems, comply with law, or provide services requested by you.

12. Payments, Fees, and Online Transactions

Certain payments, fees, deposits, application charges, rent payments, owner payments, resident charges, service charges, or other transactions may be processed through third-party payment providers or online portals.

Payment processing may be subject to separate terms, conditions, convenience fees, processing fees, return-payment fees, deadlines, or platform rules.

CBRPM is not responsible for delays, errors, outages, declined transactions, bank processing issues, or third-party payment platform issues outside of our control.

Submitting payment information does not guarantee approval, property availability, lease execution, or completion of a transaction unless all required conditions are satisfied.

13. Maintenance Requests and Emergency Communications

Residents may be provided with procedures for submitting maintenance requests, emergency maintenance requests, or repair-related communications.

Submitting a maintenance request through a portal, email, phone call, text message, or other method does not guarantee immediate completion of the repair. Response times may depend on the nature of the issue, vendor availability, owner approval where required, parts availability, access, weather, safety concerns, and other operational factors.

Emergency maintenance procedures may differ from routine maintenance procedures. Residents are responsible for following the emergency instructions provided in their lease, resident handbook, portal, or other written communication from CBRPM.

14. Website Content and Intellectual Property

All website content, including text, logos, graphics, photos, videos, rental listing descriptions, forms, documents, layouts, and other materials, is owned by or licensed to CBRPM unless otherwise stated.

You may not copy, reproduce, distribute, modify, publish, scrape, display, sell, or use website content for commercial or unauthorized purposes without written permission from CBRPM.

Property photos, descriptions, and listing information may not be reused without authorization.

15. No Legal, Financial, or Professional Advice

Information provided on our website or through our communications is for general informational and operational purposes only.

CBRPM does not provide legal, tax, insurance, financial, or tenant-representation advice. Users should consult their own qualified professionals regarding legal, financial, tax, insurance, or other professional matters.

16. No Warranty

Our website, online services, listings, forms, portals, and communications are provided on an “as available” and “as is” basis.

CBRPM does not guarantee that our website or online services will be uninterrupted, secure, error-free, current, complete, or free from technical issues.

We reserve the right to update, modify, suspend, or discontinue any portion of our website, online services, forms, tools, listings, or communication systems at any time.

17. Limitation of Liability

To the fullest extent allowed by law, CBRPM is not liable for damages arising out of or related to:

  • Use of, or inability to use, our website or online services;
  • Errors, omissions, or inaccuracies in rental listings or website content;
  • Property availability changes;
  • Third-party platform issues;
  • Communication delays or failures;
  • Payment processing issues;
  • Unauthorized account access caused by user conduct;

  • Decisions made based on website content, listing information, or electronic communications.

Nothing in these Terms & Conditions limits rights or remedies that may not be waived under applicable law.

18. Indemnification

You agree to indemnify and hold harmless CBRPM, its owners, officers, employees, agents, representatives, affiliates, property owners, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of our website, online services, portals, forms, communications, or violation of these Terms & Conditions.

CBRPM may update these Terms & Conditions from time to time. Updates will be posted on this page with a revised effective date.

Continued use of our website, online services, forms, portals, or communication systems after updates are posted means you accept the revised Terms & Conditions.

20. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
